Overview

These Terms explain the rules for using fivemilebeach.co and purchasing from Five Mile Beach Co. Five Mile Beach Company LLC operates Five Mile Beach Co. (“Five Mile Beach,” “we,” “us,” or “our”). By accessing or using the site, you agree to these Terms of Service. If you do not agree, please do not use the site.

Products & Pricing

All prices are listed in US dollars and are subject to change without notice. We reserve the right to limit quantities, refuse orders, or discontinue products at any time. In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order.

Order Acceptance & Fulfillment

Placing an order constitutes an offer to purchase. Your order is accepted when you receive an order confirmation email. We reserve the right to cancel orders for any reason, including suspected fraud, at which point a full refund will be issued.

Orders are fulfilled by Printful, a third-party print-on-demand service. Production and shipping timelines are estimates. We are not liable for delays caused by Printful, carriers, or circumstances outside our control. In the event of a fulfillment issue (lost shipment, significant damage), contact us and we will work to resolve it.

We currently sell and ship within the United States only. Free U.S. shipping applies to orders over $75 before taxes. Orders at or below $75 receive a live shipping rate at checkout.

Payments

Payments are processed by Stripe. By completing a purchase, you agree to Stripe’s terms of service. Your card details are transmitted directly to Stripe and are never stored by us. We reserve the right to refuse or cancel transactions flagged as potentially fraudulent.

Intellectual Property

All content on this site — including designs, logos, photography, copy, and branding — is the property of Five Mile Beach and may not be reproduced, distributed, or used without written permission.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@fivemilebeach.co if you suspect unauthorized access.

You may request deletion of your account at any time by contacting us. Note that order records associated with your account may be retained as required by law even after account deletion.

Disclaimer of Warranties

The site and its contents are provided “as is” without warranties of any kind, express or implied. We do not guarantee that the site will be uninterrupted, error-free, or free of viruses.

Limitation of Liability

To the fullest extent permitted by law, Five Mile Beach shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or purchase of products, including delays or errors caused by third-party services such as Printful or Stripe. Our total liability for any claim shall not exceed the amount you paid for the order in question.

Governing Law

These terms are governed by the laws of the State of New Jersey, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Cape May County, New Jersey.

Changes to These Terms

We may update these terms from time to time. Continued use of the site after changes constitutes acceptance of the updated terms.
